Article 1 - Basic provisions

1.1 The personal data controller pursuant to Article 4 (7) of Regulation (EU) 2016/679 of the European Parliament and the Council on the protection of individuals with regard to the processing of personal data and the free movement of such data (hereinafter to as “GDPR”) is with its registered office at Chaberská 38, Přemyšlení, Zdiby, 250 66 (hereinafter: "controller").

1.3 Personal data means all information about an identified or identifiable natural person; an identifiable natural person is a natural person who can be identified, directly or indirectly, in particular by reference to a specific identifier, such as name, identification number, location data, network identifier or one or more specific physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

1.4 The controller has not appointed a data protection officer.

 

Article 2: Sources and categories of personal data processed

2.1 The controller processes personal data that you have provided to him or personal data that the controller has obtained on the basis of the fulfilment of your order or registration on the controller’s website.

2.2 The controller processes your basic personal, identification and contact, service and communication data and the data necessary for the fulfilment of the contractual relationship.

 

Article 3: Legal reason and purpose of processing personal data

3.1 The legal reason for processing personal data is

  • fulfilment of the contractual relationship between you and the controller pursuant to Article 6, paragraph 1, letter b) GDPR,
  • the legitimate interest of the controller in the provision of direct marketing (especially for sending commercial messages and newsletters) pursuant to Article 6 (1) (a) f) GDPR,
  • Your consent to processing for the purposes of providing direct marketing (in particular for sending commercial communications and other marketing messages, such as newsletters) pursuant to Article 6 (1) (a) a) GDPR in connection with § 7 paragraph 2 of Act No. 480/2004 Coll., on certain services of the information company in the event that no goods or services have been ordered.

3.2 The purpose of personal data processing is

  • settlement of your order and exercise of rights and obligations arising from the contractual relationship between you and the controller; when ordering, personal data are required, which are necessary for successful fulfilment of the order (full name and address, a contact), provision of personal data is a necessary requirement for concluding and fulfilling the contractual relationship, without providing personal data it is not possible to conclude the contract or fulfilment of the relationship by the controller,
  • settlement of your winning rights and inclusion in the raffle draw for the main prize,
  • sending commercial messages and other marketing activities.

3.3 There is no automatic individual decision by the controller within the meaning of Article 22 of the GDPR.

 

Article 4: Data retention period

4.1 The controller keeps personal data

  • for the time necessary to exercise the rights and obligations arising from the contractual obligations between you and the controller and to assert claims from these contractual relationships (for a period of 10 years from the date of the termination of the contractual relationship).
  • until the consent to the processing of personal data for marketing purposes is revoked, for a maximum of 3 years if the personal data are processed on the basis of the consent.

4.2 At the end of the retention period of personal data, the controller shall delete the personal data.

 

Article 5: Recipients of personal data (subcontractors of the controller)

5.1 The recipients of personal data are persons

  • involved in the supply of services and the execution of payments on the basis of a contract,
  • providing online e-shop services and other services in connection with e-shop operation,
  • ensuring the distribution of prizes,
  • providing marketing services.

5.2 The controller does not intend to transfer personal data to a third country (a non-EU country) or to an international organization.

 

Article 6: Your rights

6.1 Under the conditions set out in the GDPR, you have

  • the right of access personal data pursuant to Article 15 of the GDPR,
  • the right to rectify personal data pursuant to Article 16 of the GDPR, or restrictions on processing pursuant to Article 18 of the GDPR,
  • the right to erasure of personal data pursuant to Article 17 of the GDPR.
  • the right to object to the processing pursuant to Article 21 of the GDPR a
  • the right to data portability according to Article 20 of the GDPR.
  • the right to rescind consent to processing in writing or electronically to the address or email of the controller specified in Article III of these conditions.

6.2 You have the right to make a complaint to the Supervisory Authority which is the Office for Personal Data Protection if you believe that your right to personal data protection has been violated.

 

Article 6: Conditions for the security of personal data

 

6.1 The controller declares that he has taken all appropriate technical and organizational measures to secure personal data.

6.2 The controller has taken technical measures to secure data repositories and repositories of personal data in paper form.

6.3 The controller declares that only persons authorized by him have access to personal data.

 

Article 7: Final provisions

7.1 By sending an order from the online order form or by registering on the controller's website, you confirm that you are familiar with the conditions of personal data protection and that you accept them in full.

7.2 You agree to these terms by checking the agreement via the online form. By checking the consent, you confirm that you are familiar with the terms of personal data protection and that you accept them in full.

7.3 The controller is entitled to change these conditions. It will publish a new version of the terms of personal data protection on its website, or send you a new version of these terms and conditions to the e-mail address you provided to the controller.

 

These conditions come into force and take effect on 1.5.2021.
